  1. Alimony may be increased or decreased based on changes in circumstances.
  2. No claim for an increase or decrease will be heard before the lapse of one year from the imposition of alimony, except in exceptional cases.
  3. Any increase or decrease in alimony is calculated from the date of the judicial claim.

Article (64) of the UAE Personal Status Law is a crucial provision aimed at ensuring justice in alimony matters during marriage or after divorce. This article provides a legal framework for adjusting the alimony amount based on changes in the financial conditions of either party. The first clause states that alimony can be increased or decreased if there are changes in the financial circumstances of either spouse, reflecting the principles of flexibility and fairness in addressing changing financial needs.

The second clause stipulates that a full year must pass before a petition for adjusting alimony can be filed, ensuring financial stability and preventing hasty and repeated lawsuits. However, this clause allows for exceptions in special circumstances that necessitate alimony adjustment before the year has elapsed, such as emergencies or significant income changes that require a prompt re-evaluation of the alimony amount.

The third clause specifies that any adjustment in alimony, whether an increase or decrease, is calculated from the date of the legal claim. This means that the adjustment does not apply retroactively but starts from the time the petition is submitted to the court. This clause ensures that financial adjustments are organized and determined based on official claims, helping to avoid disputes and differences between the parties.

Thus, this article contributes to providing legal protection for both parties, ensuring that alimony adjustments are fair and reflect the current circumstances of the parties. It emphasizes the importance of financial stability along with sufficient flexibility to adapt to emergent changes, thereby enhancing justice and equity in the distribution of financial responsibilities.
